Welcome to SocialMax. These Terms of Service ("Terms") govern your access to and use of the SocialMax platform, website, and related services (the "Service"). By using SocialMax, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using SocialMax, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you agree to these Terms and our Privacy Policy.
2. Description of Service
SocialMax is a social media management platform that allows users to:
- Connect social media accounts including TikTok, Instagram, Facebook, Twitter/X, LinkedIn, and YouTube.
- Schedule and publish content across multiple platforms.
- Upload and manage media assets (videos, images, captions).
- View analytics and performance metrics for published content.
- Collaborate with team members on content creation and approval workflows.
3. Account Registration
- You must provide accurate and complete information when creating your SocialMax account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately at support@socialmax.cloud if you suspect unauthorized access to your account.
4. Connected Social Media Accounts
When you connect third-party social media accounts to SocialMax:
- You authorize SocialMax to access and interact with those accounts on your behalf, as described in our Privacy Policy.
- You represent that you have the authority to connect those accounts and grant SocialMax the necessary permissions.
- You may disconnect any social media account at any time through your SocialMax account settings.
- SocialMax relies on third-party platform APIs (including the TikTok API). Changes to these APIs may affect the availability of certain features.
5. User Content
- You retain ownership of all content you upload to SocialMax (videos, images, text, captions).
- By uploading content, you grant SocialMax a limited license to store, process, and transmit that content solely for the purpose of providing the Service (e.g., publishing to your connected platforms).
- You are solely responsible for the content you publish through SocialMax. Content must comply with the terms of each social media platform and all applicable laws.
- You must not upload or publish content that is illegal, infringing, defamatory, hateful, or otherwise violates the rights of others.
6. Prohibited Uses
You agree not to:
- Use SocialMax for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to the Service, other users' accounts, or our systems.
- Use the Service to distribute spam, malware, or other harmful content.
- Reverse engineer, decompile, or disassemble any part of the SocialMax platform.
- Use automated tools (bots, scrapers) to access the Service except as expressly permitted.
- Violate the terms of service of any connected social media platform.
7. Intellectual Property
The SocialMax name, logo, website design, and all related software and content are the intellectual property of SocialMax and are protected by applicable copyright, trademark, and other intellectual property laws. You may not use our branding without prior written consent.
8. Third-Party Services
SocialMax integrates with third-party social media platforms and services. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of third-party platforms is subject to their respective terms and privacy policies.
9. Service Availability
We strive to maintain reliable service but do not guarantee uninterrupted access to SocialMax. We may temporarily suspend or modify the Service for maintenance, updates, or other operational reasons. We will make reasonable efforts to notify users of planned downtime.
10. Limitation of Liability
To the maximum extent permitted by law, SocialMax shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:
- Loss of data or content.
- Failed or delayed publishing of scheduled content.
- Unauthorized access to your account due to your failure to maintain security.
- Actions taken by third-party social media platforms (e.g., account suspension, API changes).
11. Indemnification
You agree to indemnify and hold harmless SocialMax, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.
12. Termination
- You may terminate your account at any time by deleting it through your account settings or contacting us at support@socialmax.cloud.
- We may suspend or terminate your account if you violate these Terms or engage in conduct that is harmful to other users or the Service.
- Upon termination, your right to use the Service ceases immediately. Data deletion will be handled as described in our Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by posting the revised Terms on this page and updating the "Last updated" date. Continued use of SocialMax after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of SocialMax shall be resolved through good-faith negotiation or, if necessary, binding arbitration.
